التطور المستمر والسريع في ميادين العلوم وتكنولوجيات الاتصالات السلكية واللاسلكية، يستدعي ويقتضي بالضرورة أن يكون البحث القانوني مواكباً هو الآخر لهذا التطور المتسارع، وقد بدا لنا من تتبعنا لما كتب حول الإثبات الإلكتروني والعلمي في مجال المعلوماتية، أن الجانب الفني المحض قد لقى حظاً أوفر من الاهتمام، على حساب التحليل القانوني والفقهي، مع قصور الاجتهادات القضائية بصفة خاصة، ولاسيما فيما يتصل بمسألة قبول الأدلة الثبوتيةالمستمدة من الوسائل العلمية الحديثة ومشروعيتها في الإثبات.
يضاف إلى ذلك، أن هذا الموضوع الذي بين أيدينا لم تتح بعد دراسته بصورة أعمق ولا سيما بالنسبة لتشريعات دول المغرب العربي مقارنة مع دول الشرق والخليج العربيين، إذ لا يعدو أن يكون تناوله هو مجرد محاولات متفرقة تكاد تكون منعدمة عند التعرض لقواعد الإثبات في المواد المدنية والتجارية والإدارية والجنائية في مجال المعاملات الإلكترونية وغيرها، ويتسمد هذا الموضوع أهميته كذلك من كونه يتصل اتصالاً مباشراً ووثيقاً بالإعلام والاتصالات عن بعد.
وعليه، وتسهيلاً على الباحث، إرتأينا تقسيم موضوع قبول البصمات في مواد الإثبات في التشريع العربي والدولي إلى ثلاثة أجزاء على النحو التالي:
الجزء الأول: البصمة الإلكترونية، الجزء الثاني: البصمة الصوتية، الجزء الثالث: البصمة الوراثية.
