من الطبيعي أن تصبح حماية البيئة من المسائل الضرورية في مجتمعاتنا الحديثة المتمدنة، بعد أن أضحت تلك المشكلة الاجتماعية من الأفكار الرائدة التي تصادفها المجتمعات في كل مدة زمنية متباعدة مما دفع بنا إلى طرح الأسئلة التالية على بساط البحث:
1. ما هي أسباب وجود المجتمع والإنسان؟ 2. ما هي القيم التي يجب حمايتها؟ 3. ما مدى قدر المجتمع على التغيير من أجل مواجهة ومجابهة المشاكل المستجدة؟
فقد ازداد اهتمام الإنسان بالتلوث البيئي عندما بدأ يشعر بارتباط زيادته هذه بزيادة التقدم العلمي والتطور التكنولوجي، وبدأت كثير من الدول تعيد النظر في تشريعاتها وقوانينها الخاصة بهذا الشأن، كما زاد الاهتمام بتنظيم العلاقات الدولية بعد ما ثبت اتساع نطاق ضرر التلوث البيئي سواء من حيث الزمان أو من حيث المكان وقدرته على عبور الحدود الدولية وإلى أكثر من دولة وأكثر من قارة.
حيث أصبحت مشكلة التلوث البيئي من المشكلات الخطيرة التي باتت تواجهنا في الوقت الحاضر، وهذا التلوث إنما هو ضريبة التقدم العلمي والتطور التكنولوجي الذي بدأ يزداد وباطراد منذ ظهور الثورة الصناعية وإلى وقتنا الحاضر وسيستمر.
عليه وإدراكاً ما لهذه المشكلة من عواقب وخيمة، سعت الدول جاهدة سواء أكان ذلك على المستوى الداخلي أو الدولي في البحث عن حلول للمشكلات التي تسبب هذا التلوث، خاصة وأن مخاطر وأضرار هذا التلوث لم تقتصر على الدول التي تتسبب فيه بل امتدت آثاره إلى الدول الأخرى مما يشكل خطراً يهدد الأرواح والممتلكات ويهدد البيئة الطبيعية ومكوناتها من ماء وهواء وتربة.
وأدى تشابك النظم البيئية إلى اعتبار قضايا ومشكلات البيئة ذات سمة دولية عالمية أكثر مما هي داخلية وطنية وأصبحت فكرة حماية البيئة رغم حداثتها حقاً من الحقوق الأساسية للإنسان، اعترف به على المستويين الداخلي والدولي، وهو ما أكسب قانون حماية البيئة وصف قانون التضامن والتصالح، إذ عكس بحق استجابة الرأي العام في كل الدول إلى ضرورة المضي قدماً نحو حماية البيئة والحفاظ عليها، مما ساعد على تحقق التضامن بين الطبقات الاجتماعية المتفاوتة الفقيرة منها والغنية في البلد الواحد، وكذلك تحققه بين البلدان المختلفة لبلوغ ذلك الهدف.
