دفعنا لاختيار التنظيم القانوني للإضراب هو ما تشهده الآونة الأخيرة من إضرابات حتى صار الإضراب ظاهرة يتكرر اللجوء إليها في أكثر من منشأة. وإذا كانت وزارة القوى العاملة تحاول التقليل من شأن هذه الظاهرة بدعوى أن حالات الإضراب نادرة إذا قورنت بعدد المنشآت العاملة في مصر فإن ذلك لا يعني التقليل من شأن تفاقم حالات الإضراب وتزايد عددها يوماً بعد يوم خاصة في ظل تسارع وتيرة الخصخصة الذي ينذر بعواقب وخيمة وهو ما يجعل حق الإضراب الوسيلة الفاعلة للحفاظ علي حقوق العمال. ولما كان قانون العمل يتسم بالطابع الواقعي وبكونه يرتبط بظروف المجتمع ويتطور بتطوره فإن هذا القانون يجب أن يتواءم مع المستجدات التي لحقت بالمجتمع. وغذا كانت مشروعية الإضراب في ضوء قانون العمل الحالي باتت أمراً سالماً فإن التنظيم الذي وضعه المشرع لهذا الحق يستحق لبيان مدى اتفاقه مع الاتفاقات الدولية والطموحات العالية ومدى فاعلية هذا الحق كوسيلة يلجأ إليها العمال عند الضرورة للدفاع عن حقوقهم ومصالحهم المهنية المشروعة. من أجل ذلك كانت هذه الدراسة التي تقودنا لمعرفة مدى التوازن بين حقوق العمال وأصحاب الأعمال ومدى جدية المشرع في جعل الإضراب وسيلة حقيقية وفاعلة في يد العمال للدفاع عن مصالحهم المشروعة وكذلك مدى جدوى هذا التنظيم في تلافى الآثار الاجتماعية والاقتصادية لممارسة هذا الحق ولبلوغ هذه الغاية فإننا نرى تقسيم هذه الدراسة علي النحو التالي: "مفهوم الإضراب وعناصره وصوره، أساس حق الإضراب وشروط ممارسته، آثار ممارسة حق الإضراب".
