إن موضوع الحدود القانونية لاستخدامات القوة في العلاقات الدولية هو من أهم موضوعات القانون الدولي المعاصر، ليس فقط لأنه يتعلق بسلامة وأمن الدول على انفراد، أو بأمن المجتمع الدولي ككل، ولكن أيضًا لأنه يثير قضية منهجية تتعلق باستقلال علم القانون عن علم السياسة، أو الترابط أو التداخل بينهما، كما يثير قضية منهجية أخرى تتعلق بالأساس الإلزامي للقانون الدولي العام، والتي انقسم الرأي بشأنها إلى عدة مدارس فقهية، ولا يتسع المقام لمناقشة هاتين القضيتين تفصيلًا، وإن تعرضنا لبعض جوانبها من خلال بحث وتطور مبدأ استخدام القوة في العلاقات الدولية، ومن المعلوم أن القانون الدولي المعاصر يتضمن قاعدة أساسية ذات طبيعية آمرة تحظر استخدام القوة، أو التهديد باستخدامها، في العلاقات الدولية، وقد تم إقرار هذه القاعدة بشكل مباشر وصريح في المادة (2 فقرة 4) من ميثاق الأمم المتحدة الصادر في 1945، وفي مواثيق دولية كثيرة أخرى لاحقة، وبمقتضى قرارات صادرة من منظمات دولية عالمية وإقليمية، ومن المسلم به أن هذه القاعدة قد اكتسبت صفة القاعدة العرفية العامة التي تلزم جميع الدول.
