ولد في مدينة قارة بريف دمشق في 1971/4/19م.سجل في كلية الشريعة بجامعة دمشق، ليحصل على درجة البكالوريوس عام 1996م والدبلوم سنة 1997م ثم الماجستير عام 2001م بمرتبة جيد جداً ، فالدكتوراه في أصول الفقه عام 2009م بدرجة 95 مع مرتبة الشرف توفي رحمه الله في لبنان بعد معاناته مع مرض ضمور العضلات عام 2015
Book Description
يعدّ القانـون الدولي فرعاً مستقـلاً من فروع القانـون، والذي قسَمـه فقهاء القانون إلى قسمين رئيسين هما: القانون الدولي العام، والقانون الدولي الخاص. فتناول القانون الدولي العام موضوعات المعَاهَدات والدول والحرب والسلم والعلاقات الدولية ...إلخ.
بينما تناول القانون الدولي الخاص موضوعات أساسيـةً تتمثل في: الجنسية، والمركز القانوني للأجانب، وتنازع القوانين، والتنازع القضائي فقط.
وإذا كان القانون الدولي فَرعاً متميزاً من فروع القانون الوضعي، فإن الفقه الدولي الإسلامي يُعدّ أصلاً مؤصَّلاً من مجموع الفقه الإسلامي، وأساساً سابقاً في نشوئه وتفصيله على القانون الدولي الوضعي، إلا أن التشريع الإسلامـي لم يعرف هذا التقسيم الاصطلاحي بين الفقه الدولي العام والفقه الدولي الخـاص، بل جاءت الأحكام في مصطلح عام هو السِّيَر أو الفقه الدولي.
ومع توسع العلوم وازدياد التخصص والتقسيم قررتُ تناولَ هذا الجانب من الفقه الإسلامي والمقابل للقانون الدولي الخاص، فقمتُ بدراسة أحكام الجنسية في التشريع الإسلامي في رسالة الماجستير، ومِن ثَمّ قررتُ متابعة البحـث في رسالة الدكتوراه؛ لما للموضوع من أهميةٍ تتجلى في معاصرته للواقع الدولي وأصالته في التشريع الإسلامي وواقع الدولة الإسلامية.
وإيماناً برسوخ الإسلام وشُمولية أحكامه، واستيعابه لتطورات الزمان والمكان ولمتغيرات التاريخ، والواقع الإنساني على الصعيد الدولي خاصةً، وما طرأ على علاقاته وقضاياه من تطور، وإيماناً بمستقبَل الإسلام وتجذُّرِه في النفوس والواقع؛ فإن الفقـه الإسلامي الدولي ينبغي أن يبقى الرائـد في مجاله، المتقدمَ في نظرته، العالي في أحكامه، لذلك أبحث في هذه الأطروحة علاقةَ الأجنبـي بالدولة الإسلامية على صعيد الحقوق الدولية الخاصة من خلال دراسـة مركز الأجانب وحقوقهم، ودراسة الاختصاص القضائي الدولي لضمان حق التقاضي في الدعاوى ذات العنصر الأجنبي في الدولة الإسلامية.
