إنّ أحكام الشريعة جاءت لبناء الإنسان، فهي لذلك صالحة لكل زمان ومكان، حيث جاءت هذه الأحكام كاملة لا نقص فيها، جامعة تحكم كل حالة، مانعة لا تخرج عن حكمها حالة، شاملة لأمور الأفراد والجماعات والدول، فهي تنظم الأحوال الشخصية والمعاملات وكل ما يتعلق بالأفراد، وتنظم شؤون الحكم والإدارة والسياسة وغير ذلك مما يتعلق بالجماعة.
ولم تأت الشريعة لوقت دون وقت، أو لعصر دون عصر، أو لزمن دون زمن، وإنما هي شريعة كل وقت، وشريعة كل عصر، وشريعة الزمن كله حتى يرث الله الأرض ومن عليها.
وقد صيغت هذه الشريعة بحيث لا يؤثر عليها مرور الزمن، ولا يبلي جِدَّتها، ولا يقتضي تغيير قواعدها العامة ونظرياتها الأساسية، فجاءت نصوصها من العموم والمرونة بحيث تحكم كل حالة جديدة ولو لم يكن في الإمكان توقعها، ومن ثم كانت نصوص الشريعة غير قابلة للتغيير والتبديل كما تتغير نصوص القوانين الوضعية وتتبدل.
وبالنظر إلى قانون الأحوال الشخصية القديم نرى أنه قد مر على العمل به حوالي أربعة عقود، ومن خلال هذه العقود تغيرت أمور واستجدت أخرى من هنا اقتضت الضرورة وضع قانون عصري وحديث للأحوال الشخصية يحدد حقوق وواجبات كل طرف ، حتى لا تتشابك المصالح، أو تسود الفوضى فيما بينهم وتضطرب حياتهم نتيجة لظروف التطور الاجتماعي، ونتيجة للتفاعلات السياسية، والعوامل الاقتصادية، والمعتقدات الدينية.
