فقد استجدت أمور كثيرة دعت إلى إعادة النظر في قانون الأحوال الشخصية المعمول به في المملكة الأردنية الهاشمية، والقانون استمد أحكامه من أصول ثابتة لا ينالها التغيير والتبديل كمشروعية الزواج والطلاق والنسب والحضانة والنفقات والمواريث. فهذه من الثوابت التي لا تتغير بتغير الزمان والمكان وبعض أحكام القانون مستمدة من أصول تتغير بحسب الزمان والمكان كالأحكام المستمدة من العُرُف، أو التي تستند إلى السياسة الشرعية، والأحكام المعللة فإن الحكم يدور مع علته وجوداً وعدماً كما هو مقرر عند العلماء، وإذا تقرر ما سبق فإن قانون الأحوال الشخصية يتضمن أحكاماً ثابتة لا تتغير وأحكاماً غير ثابتة، وقد تم إعادة النظر في الأحكام غير الثابتة بغية الترتيب والتقسيم أو تقنين الموضوعات التي لا تقنن كالأهلية والوصاية والمواريث أو إضافة بعض الأحكام التي تحقق الإستقرار الأسري كالحد من حالات الطلاق وكالتفريق للعقم وإثبات النسب بالوسائل العلمية القطعية الدلالة. وقد تمت صياغته في ثلاثمائة وثمان وعشرين مادة (328) وصدر القانون تحت رقم (36) لسنة 2010 م . ونظراً لحاجة الطلبة وأهل الإختصاص إلى معرفة الأصول والمذاهب والأقوال الفقهية التي استند إليها القانون الجديد فقد تم إعادة النظر في هذا الكتاب لاستيعاب تلك الأحكام وبيان أصولها الشرعية.
