هذه الطبعة الخامسة من كتاب عقد البيع وقد حرصت كالعادة على تزويدها بأحدث ما ظهر بعد الطبعة الرابعة آراء الفقاء وأحكام المحاكم حتى يونيه سنة 1989. وقد حظى الفصل الخاص بالالتزام بنقل ملكية المبيع بأوفر نصيب من الاضافات نظرة لوفرة وتنوع الأحكام التى صدرت فى شأن شهر عقد البيع ودعوى صحة التعاقد وتزاحم المشترين، دون أن يقلل ذلك من نصيب الفصول الأخرى من هذه الاضافات أخص بالذكر منها حكم الهيئة العامة للمواد المدنية والتجارية والأحوال الشخصية بمحكمة النقض الصادر فى 16 فبراير 1986 الذى أرسى نهائيا- بعد خلاف طال أمده- مبدأ حماية الأوضاع الظاهرة ورعاية مصلحة المتعاملين معها بحسن نيه، كما هو شأن المشترى بحسن نيه من المالك الظاهر أو من الوراث الظاهر أو من الوكيل الظاهر إلخ ..
كما أخص بالذكر فيما يتعلق ببيع الأشياء المستقبلة قانون 3 يناير 1961 الصادر فى فرنسا، وكذلك القانون الفرنسى الصادر بتاريخ 13 يونيه 1984 بتنظيم بيع العقارات.
