إن النفس الإنسانية لمجبولة على الشح والبخل فإن لم يكن ترغيب فى الدين، ولم يكن استيثاق فى قضائه، لم يكن هناك من يقرض وتعطلت مصالح البشر، وطرق الاستيثاق فى الشرع كثيرة، ولعل أبرزها ثلاث معاملات:
1- الكفالة والضمان، 2- الرهن، 3- الشهادة
فالضمان- وهو كفالة المال- يكون للدين وكفالة النفس لإحضار بدن الغريم، وفائدتها: إلزام الضامن بالوفاء، مع إلزام صاحب الحق، فيتعلق الحق بذمة كل منهما. وقد أجبت أن أكتب فى هذه الرسالة شيئاً عن الكفالة كطريق من طرق الاستيثاق أبين فيها العلاقة بينها وبين الضمان، وما يترتب على مثل هذه العقود، لاسيما وأنها عقد تبرع وإحسان، فقيها معاونة الفقراء والمساكين وهذا دأب الصالحين، مما يزيد فى الرابطة الاجتماعية، وأبين كذلك ما يقطع فى كثير من مسائله وقد رتبتها على صيغة السؤال والجواب ولم أنس أن أشير إلى المعاملات الحادثة كالضمان البنكى لتعلقه بالموضع وتعلق البحث به.
