إن نظرية الظروف الطارئة من أشد موضوعات القانون الدولي المدني دقة، وأكثرها إتساعاً لإختلاف وجهات النظر، فهي بعد ما زالت في نطاق البحوث التي يقوم حولها الجدل لأن الشرائع التي أخذت بها ما برحت قليلة.
ولما كانت حضارات الأمم، ورقيها تقاس بتقدم قوانينها وأن من ألصقها بالحياة الإجتماعية، والإقتصادية العقود التي هي وسيلة التبادل، والإنتفاع بين بني البشر.
وتعتبر نظرية الظروف الطارئة من النظريات التي ابتكرها القضاء الإداري في العصر الحديث لحماية المتعاقد مع الإدارة من المخاطر التي يتعرض لها وبالتالي لإعادة التوازن الإقتصادي للعقد الإداري.
ومن هذا المنطلق، اختار المؤلف هذا الموضوع الذي يدور حول جانب من جوانبه المتصل بالعلاقة بين أطراف العقد، بإعتباره أهم مصدر من مصادر الإلتزام، وفي أهم جوانبه وهو العدل في العقد.
وقد التزم في خطبة البحث إجراء المقارنة بين القانون المدني الأردني والفقه الإسلامي بإعتباره مصدر أساسي لنصوصه، وبعض التشريعات الحديثة المختلفة ما أمكن ذلك والقانون الإداري بإعتباره المصدر الحديث لهذه النظرية وتطبيقاتها ومدى إنعكاس ذلك على القانون المدني الأردني.
