الصحافة، تلك السلطة التي ما إن ظهرت حتى طربت لصوتها الآذان، وتفتحت لها الأذهان، كيف لا وهي "صاحبة الجلالة" الباحثة عن الخلل في الأداء، والمقيمة لدور قطاعات الدولة كافة، والحارس الأمين لحقوق الشعب، وغاياته في عيش كريم؟
وبرغم ذلك، بقيت "السلطة الرابعة" تعاني من قيود تحاول فرضها السلطة التنفيذية، لتقييد عملها، وتقزيم قدرتها على الأداء، معتقدة بذلك أن "الصحافة عدو لا صديق" يتصيد الأخطاء، ويضخمها، كما بقيت الصحافة في كثير من الدول، ومنها دول العالم الثالث، ترزح تحت وطأة قوانين متعددة تقيدها وتعيق تدفق المعلومات من خلالها، في وقت أدركت فيه دول أخرى متقدمة أهمية "الصحافة" في تحقيق الطموح الشعبي عبر بيان جوانب الخلل، ومعالجتها وصولا إلى عيش كريم.
وفي الأردن، ما زال يتعلق بالصحافة 24 قانونا بصورة مباشرة، أو غير مباشرة منها ما يحد من حرية النشر، وأبرز هذه القوانين التي تتعلق بالعمل الصحفي قانون العقوبات رقم 16 لسنة 1960 وتعديلاته الذي ينص على أحكام الذم والقدح بأكثر من وسيلة بما فيها النشر في المطبوعات والصحف، لذا فقد آثرت ــ في ظل ندرة الدراسات القانونية المتخصصة في هذا الموضوع ــ أن أضع خلاصة جهدي في البحث والتمحيص والتدقيق لبيان الجوانب القانونية لجريمتي الذم والقدح عبر النشر في القانون الأردني، مسترشدا بالأحكام القضائية الصادرة في هذا الجانب وبنصوص قانون العقوبات الأردني والقانون المقارن. وتأتي هذه الدراسة بعد إقرار قانون المطبوعات والنشر الأردني الجديد رقم 27 لسنة 2007 الذي تصنفه الحكومة ضمن القوانين العصرية في إطار حرية الرأي والتعبير، خصوصاً وأنّ هذا القانون يمنع التوقيف في القضايا المتعلقة بإبداء الرأي وحريته، في وقت يمكن فيه محاكمة الصحفي وفق أحكام قانون العقوبات بجريمتي الذم والقدح عبر النشر في وسائل الإعلام.
وبحثت هذه الدراسة كذلك بالتحليل، والتمحيص، حق الصحفيين بالحصول على المعلومات والأخبار ونشرها، لكن هذه الحرية مقيدة "بواجب البحث، والتدقيق" فيما يحصل عليه الصحفي من معلومات للتأكد من مدى صحتها قبل نشرها.
