"وحرية الصحافة كما هو معروف هي أحد صور الرأي"، وبالتالي فإن حماية حرية الرأي تعني في الوقت نفسه حتماً ولزوماً كفالة حرية الصحافة، فهي في الوقت الذي تمارس فيه وظيفتها الأساسية، وهي نشر الأخبار التي تهم الجمهور مهما كان نوعها، فيجب أن نلاحظ أن هناك في الكثير من الأحيان مصلحة أولى بالرعاية من حق الجمهور في الإعلام، وهي مصلحة الدولة في الحفاظ على أسرارها العسكريا والعلمية المتقدمة، وما يتعلق بالأمن الداخلي أو الخارجي، وكذلك احترام حرمة الحياه الخاصة.
والجريمة الصحفية هي ككل الجرائم، وكلها تختلف عن الجرائم العادية لكونها جرائم ذهنية تتمثل في الإعلان عن فكر أو رأي بسوء قصد يعاقب عليه القانون، هذا إلى جانب أن التأثير الخطير الذي تحدثه الصحافة في نفوس الأفراد يجعل الجريمة الصحفية أكثر خطورة من غيرها على النظام العام، والمصالح التي يحميها القانون وهذا ما جعل المشرع يخضعها لأحكام خاصة ورغم أن الجرائم التي ترتكب بواسطة الصحف كالتحريض والقذف والسب... هي من جرائم القانون العام وطبيعتها واحدة، وأركانها لا تتغير، ولكن ما يميزها هو أن العلانية أحد أركانها، وهذا الركن يكون بمثابة ظرف مشدد.
ولا ننسى أن التقدم الفني والتكنولوجي قد أدى إلى تطور وسائل الإعلام وتبادل الآراء والأفكار والأخبار التي تمس مختلف جوانب مجالات حياتنا الاجتماعية فهناك الكتب والصحف والمجلات والإذاعات المسموعة والمرئية، وغير ذلك من وسائل التعبير عن الرأي، أي أنه إلى جانب الصحافة المكتوبة، هناك الصحافة المسموعة والمرئية، وقد ازداد دور كل هذه الوسائل في الوقت الحاضر كأثر للتقدم العلمي، ونركز دراستنا هذه على الصحافة المكتوبة ونتحدث عن جرائم الصحافة والنشر في البابين التاليين: الباب الأول: الأحكام العامة للجرائم الصحفية، الباب الثاني: أهم صور الجرائم الصحفية.
