يعني مبدأ التقاضي على درجتين إتاحة الفرصة للخصم الذي حكم لغير صالحه بعرض النزاع أمام محكمة أعلى درجة لتفصل فيه من جديد، فتقسم المحاكم إلى مجموعتين، محاكم الدرجة الأولى وتنظر النزاع لأول مرة، ومحاكم الدرجة الثانية وتنظر النزاع للمرة الثانية، والوسيلة العملية لطرح النزاع على محاكم الدرجة الثانية هي الاستئناف
ويعتبر مبدأ التقاضي على درجتين من المبادئ الهامة التي تقوم عليها ال يعني مبدأ التقاضي على درجتين إتاحة الفرصة للخصم الذي حكم لغير صالحه بعرض النزاع أمام محكمة أعلى درجة لتفصل فيه من جديد، فتقسم المحاكم إلى مجموعتين، محاكم الدرجة الأولى وتنظر النزاع لأول مرة، ومحاكم الدرجة الثانية وتنظر النزاع للمرة الثانية، والوسيلة العملية لطرح النزاع على محاكم الدرجة الثانية هي الاستئناف
ويعتبر مبدأ التقاضي على درجتين من المبادئ الهامة التي تقوم عليها النظر القضائية المعاصرة، لما يكفله من حسن سير العدالة، إذ يحث قضاة محاكم الدرجة الأولى على العناية بأحكامهم والتأني في إصدارها خشية إلغائها أو تعديلها من محاكم الدرجة الثانية، كما يسمح للخصوم بتصحيح ما قد يقع فيه القاضي من أخطاء ويمكنهم من تدارك ما فاتهم من أوجه دفاع أمام محكمة الدرجة الأولى فضلا عن أنه يشبع غريزة العدالة في نفس المحكوم عليه بإتاحة الفرصة أمامه بعرض النزاع من جديد أمام محكمة أعلى درجة قضاتها أكثر عددا وأكثر خبرة
