هذا الكتاب دراسة قانونية –انتقادية تأصيلية مقارنة لمسؤولية الدولة الجنائية ضمن مفهوم القانون الدولي العام، لتأتي إلى جانب مسؤولية الدولة المدنية. وهي عامة لا تختص بحالة واحدة أو جريمة دولية معينة، بل تشمل ما تضمنته المواثيق الدولية وما أقرته الشرعية الدولية وأتت به الاتفاقيات والمعاهدات الدولية وما خلفته الحروب العالمية وغيرها...
ويأتي مووضع البحث في ثلاثة أبواب يتضمن كل منها ثلاثة فصول وخاتمة. خصص الباب الأول لتعريف الجريمة الدولية بمفهومها الواسع؛ وكذلك تعريفها على صعيد الفقهي الغربي والعربي الدوليين ولجنة القانون الدولي، أما الباب الثاني فخصص للمفهوم التشريعي لمسؤولية الدولة، ما هو أساسها القانون والشرعي وفق النظريات المعروفة في القانون الداخلي كنظرية الخطأ والتعسف في استعمال الحق ونظرية العمل غير المشروع ومسؤولية الدولة على أساس المخاطر.. الخ. أما الباب الثالث والأخير فجاء بعنوان المفهوم القضائي لمسؤولية الدولة، ويبدأ بالدعوى الجنائية الدولية وكيفية تحريكها وما مدى إمكانية التكامل القضائي الدولي، كيف تتم إجراءات المحاكمات الدولية التي تحوي ضمانات وحقوق المتهمين دولياً أثناء التحقيق والمحاكمة. كيف يتم الطعن بالأحكام الدولية... الخ. هذا، وقد أرفق الباحث كتابه هذا مشروع مواد مسؤولية الدول عن الأفعال غير المشروعة دولياً لعام 2001 باعتباره المشروع الأحدث لقواعد المسؤولية الدولية المدنية والجنائية. وكذلك ملخص باللغتين الكوردية والانكليزية.
