بخلاف الوضع القانوني الذي كان عليه المجني عليه في محاكم يوغسلافيا ورواندا من إعطائهم وظيفة إجرائية مقتصرة على الإدلاء بالشهادة، أعطى النظام القانوني للمحكمة الجنائية الدولية الدائمة دوراً مختلفاً له.
وعلى الرغم من أن نظام روما الأساسي لم يبين الأغراض المبتغاة من وراء مشاركة الضحايا الأحياء في الإجراءات ولم يبين كيفية وحيثية المشاركة وترك ذلك كله للاجتهاد القضائي، فإننا حاولنا في هذا المسعى العلمي غلى رفع الغموض عن ضوابط المشاركة وكل ذلك في حدود التوازن الإجرائي بين الأطراف.
إن هذا الكتاب، وما يحتويه بين دفتيه محاولة مخلصة لتأطير هذه المشاركة وتحقيق أهداف أكثر شمولاً للعدالة الجنائية الدولية، حيث لا تستوي العدالة الجنائية في سياقها العالمي ما لم يجسد دور للضحايا في إجراءات محاكمة مجرمي الحرب خصوصاً ونحن نعايش في منطقتنا ارتكاب الجرائم الماسة بكيان البشر وبالمنظومة البشرية على نطاق واسع.
