إن حماية المستهلك اصطلاح حديث نسبيا برز تبعا للتحول الدولي لاقتصاديات السوق منذ أواخر القرن الماضي، فظهرت جمعيات المجتمع المدني لحماية المستهلك والتي اتخذت من هذا الاصطلاح هدفا تسعى لتحقيقه, ويتمحور مفهوم حماية المستهلك فـي كفالة حق المستهلك فـي الحصول على منتوج يلبي رغباته واحتياجاته فـي مقابل ما قدمه من ثمن ووفقا لما اتفق عليه مع المورد أو ما هو متعارف عليه بصدده وهو حق يتعين احترامه بضمانة الدولة التي لها الأدوات اللازمة لذلك. والمستهلك المغربي يحتاج أكثر من أي وقت, إلى قانون لحمايته من شتى الظواهر التجارية غير المشروعة المستشرية, مثل ارتفاع الأسعار, والاحتكار, والغش والتزوير, والتهريب, والتدليس, والاحتيال على القوانين, كما أن الاقتصاد الوطني نفسه, فـي حاجة إلى هذا القانون, لاسيما أن البلاد أبرمت اتفاقيات التبادل الحر, مع عدد من الدول والتجمعات, ما يفرض عليها التركيز أكثر على هذا الجانب. وفـي هذا الإطار جاء القانون رقم 31.08 القاضي بتحديد تدابير لحماية المستهلك الذي عرفت مسطرة إقراره فـي المغرب تباطؤا ملحوظا، علما بأن الصيغة الأولى لهذا القانون ظل يراوح مكانه منذ عام 1999، حيث قدم كمسودة أولى فـي عهد حكومة التناوب التي كان يترأسها الوزير الأول عبد الرحمان اليوسفي، بيد أنه ظل فـي رفوف الأمانة العامة للحكومة، إلى غاية أن أعطى الملك محمد السادس تعليماته للحكومة فـي خطاب ذكرى ثورة الملك والشعب لسنة 2008، بتسريع إصدار ميثاق حماية المستهلك، لتتم إحالته من طرف الحكومة على مجلس النواب بتاريخ 29 أكتوبر 2008، واستغرقت دراسته وتحليله أكثر من سنتين لتتم المصادقة عليه بصفة نهائية من طرف البرلمان فـي يناير 2011 .
