أصبح المستهلك محاطاً بالعديد من العوامل التى أدت إلى تنامى مقومات ضعفه بصورة غير مسبوقة، وعلى نحو يبرر سرعة العمل على حمايته، ويمثل هذا الواقع الذى أفتقد خلاله المستهلك القدرة على الدفاع عن مصالحه الاقتصادية والصحية، أسباب هذه الدراسة، ونستطيع أن نتبين ذلك على نحو أكثر تفصيلا لدى إلقاء الضوء على ما أحاط مجددا بعناصر العلاقة العقدية، وما يرتبط بها إجمالا.
وفيما يتعلق بالعقد، فإن عقود الاستهلاك تعد -على النحو الذى ستشير إليه الدراسة تفصيلا فيما بعد- من عقود حسن النية. نظراً لأن المستهلك يقدم على شراء السلعة واستخدامها بناء على المعلومات التى يحصل عليها من البائع، أو تلك المدونة عليها، وبالتالى فإن المعلومات غير الصادقة أو البيانات المضللة التى تقدم للمستهلك قد تكون هى الدافع للتعاقد.
وبناء على ذلك أصبح التوازن العقدى يميل نحو الجنوح لصالح البائع أو المورد من جراء التطور الذى لحق بشروط السوق، فالمستهلك أصبح لا يملك مقومات التفاوض الحقيقى فى هذه العقود، ومن ثم غابت لديه القدرة على النقاش الموضوعى فيما يتعلق بأمر التعاقد، ويعكس ذلك بصورة مباشرة عدم تحقق أى من عناصر المساواة الاقتصادية بين الأطراف.
وفى عقود الاستهلاك بصفة خاصة فإن الصورة تبدو أكثر وضوحا، حيث لا تزال قواعد القانون المدنى هى التى تطبق عليها كسائر العقود الأخرى رغم أنها لا تولى شخصية المستهلك أى اعتبار.
يتمثل الهدف من هذه الدراسة فى الوقوف على مدى كفاية الوسائل الفنية التى تحتويها النظرية العامة للعقد فى التغلب على المشكلات العقدية الحديثة بأنواعها المختلفة، والتى باتت تهدد مصالح المستهلكين بشتى صورها، على نحو أسفر عن وجود اختلال حاد بين مراكزهم القانونية من جانب. ومراكز المنتجين أو البائعين من جانب آخر، وإلى أى مدى يمكن تطوير هذه الوسائل لتأتى متلائمة مع مطلوبات هذه الحماية بمفهومها المعاصر.
