ظهرت في الآونة الأخيرة مشكلة تحد من أكبر مشكلات المجتمعات الحديثة وأشدها خطراً، وهذه المشكلة تتعلق بالاستهلاك، وأصبح الفرد اليوم مستهلكاً بالدرجة الأولى في كل مقومات حياته، كما أصبح شغله الشاغل كيف يحصل على ما يستهلكه بالكمية المناسبة، وبالصفة الجيدة وبالسحو العادل، وأصبح الفرد اليوم يكافح جبروت المنتج والوسيط البائع، إذ أن احتياجه لهؤلاء الأشخاص في يومه هذا أشد ما يكون عن احتياجه إليهم في أمسه.
وفي جميع الأحوال يظل الفرد المستهلك خاضعاً لارادة هؤلاء المنتجين يعبثون به وبارادته وحريته، وهو في كل هذا مضطر للتعامل معهم، ونتيجة حتمية لهذا ظهر ما يعرف بالمسألة الاستهلاكية، وأطلقت صيحات تحمل مصطلحات جديدة مثل حريات المستهلك، واستدعى الأمر تدخل المشرع لكي يقوم بفرض قواعد قانونية جديدة لحماية المستهلك ورضع العنت عنه، ولقد ازداد تدخل المشرع في هذا المجال إلى الدرجة التي المح بعض رجال الفقه الفرنسي إلى أنه أصبح يوجد قانون مستقل في الوقت الحالي يدعي قانون الاستهلاك وهو ما نحاول مناقشته في بحثنا هذا.
