بما ان التجارة البحرية هي عماد التجارة الدولية لرخص وسائل النقل فيها، وحيث مشارطة الايجار وسند الشحن هما اهم وثيقتين تحرران لإبرام عقود النقل البحري الذي مثل بدورة اهمية كبيرة لعموم الدول واللعراق والدول العربية بصفة خاصة ، فقد اصبح من الضروري ان يضمن الافراد العقود المذكورة تفاقيات للتحكيم يقررون فيها إخضاع النزاعات التي تنشا عن ممارستهم لذلك النشاط الى التحكيم ومن ظهرت صيغ متعددة لاتفاقيات التحكيم سواء أكانت تلك في سندات الشحن ام في مشارطات إيجار السفن وقد كان بعضها موافقا وموافقا للقانون ولحاجة التجارة الدولية وبعضها الاخر لم يكن كذلك كما انه يحقق مصلحة طرف دون اخر، الامر الذي يجعل المسؤولين للبحث عن الصيغ التي توازن بين مصلحة الطرفين، وكذلك حاجات التجارة الدولية والغرض من التحكيم هذه الاسباب والعوامل كلها تجسد اهمية موضوع التحكيم التجاري البحري والدافع وراء البحث فيه .حيث بين هذا الكتاب مفهوم سند الشحن وشكله ووظيفته والبيانات الموجودة عليه، كما يشير انواع سندات الشحن والتي تقسم بدورها اى سند الشحن العادي والسند برسم الشحن وسند الشحن المباشر ويضاف الى ذلك توضيحه لمفهوم مشارطة ايجار السفن وانواع هذه المشارطات كما يتابع الحديث عن التحكيم كواحد من اهم الانظمة لذا فهو يتناول مفهوم التحكيم وطبيعة انواعه ولا ينسى الاشارة الى تقسيمات التحكيم المختلفة بناء على اسس معينة .
