قضاء الأمور الإدارية المستعجلة موضوع تضارع أهميته القضاء الموضوعى في المنازعات الإدارية، وعلى الرغم من ذلك لم يحظ باهتمام فقهي يتناسب مع تلك الأهمية، ومن الطلبات المستعجلة ما هو سابق على صدور حكم في الدعوى الموضوعية، كما في حالة طلب وقف تنفيذ القرار الإدارى المطعون عليه بالإلغاء.
كما أن الطلبات المستعجلة ما هو تالى لصدور الحكم في الدعوى، وإذا كان طلب تنفيذ القرار الإدارى مرتبط بطلب إلغائه، حيث لا يقبل بدونه باعتباره فرعاً من أصل، وإشكال التنفيذ متصل بحكم صدر وثار نزاع حول تنفيذ، فإن هناك من الدعاوى الإدارية المستعجلة ما يستقل بذاته عن دعوى قائمة أو حكم قد صدر.
لذلك سوف يكون تناولنا لقضاء الأمور الإدارية المستعجلة من خلال إلقاء الضوء على طلب وقف تنفيذ القرار الإدارى وإشكالات تنفيذ الأحكام الإدارية إضافة إلى دعوى تهيئة الدليل.
والقاسم المشترك بين جميع دعاوى القضاء المستعجل وطلباته هو طابع الاستعجال، الواجب إثباته في طلب وقف تنفيذ القرار الإدارى كشرط لقبوله والمفترض توافره إلى أن يثبت العكس في إشكالات تنفيذ الأحكام الإدارية، والذى يعد شرطاً لقبول دعوى تهيئة الدليل.
وكل ما سبق سوف يكون محل دراستنا في هذا المؤلف الذى أدعو الله سبحانه وتعالى أن أكون قد وفقت من خلاله في عرض قضاء الأمور الإدارية المستعجلة.
