لابد من البحث عن مدى أهمية الاعتراف للقاضي الإداري للأمور المستعجلة بسلطة توجيه الأوامر لجهة الإدارة حتى يتم تفعيل سلطته في الحماية العاجلة، سواء في مجال وقف تنفيذ القرارات الإدارية، سواء الايجابية أو السلبية، وبصفة خاصة القرارات الصادرة برفض طلبات الطاعن من قبل جهة الإدارة، أو في مجال الإجراءات التحفظية العاجلة، أو في مجال حماية الحرية الأساسية، وهل سلطة قاضي الأمور المستعجلة واحدة في هذه المجالات، أم أن الوضع يختلف وما هو مدى هذا الاختلاف ومدى تأثيره على سلطة هذا القاضي، وهل سيؤثر هذه السلطة على بعض المسلمات مثل ضرورة اتخاذ الإجراءات محل الأمر طبيعة مؤقته، وإلى أي مدى تأثرت هذه المسلمات بهذه السلطة، وهل تأثر القضاء الإداري المصري بذلك، وما هي الفائدة من إصدار الأوامر في مجال الإجراءات التحفظية العاجلة، وهل تفسر الواقعية سلطة توجيه الأوامر في هذا النطاق؟.
وعلى ذلك تنقسم دراستنا إلى فصلين على النحو التالي:-
الفصل الأول: تقارب السلطات المتعلقة بتوجيه الأمر الممنوحة للقاشي الإداري للأمور المستعجلة، الفصل الثاني: استمرار ازدواجية سلطة توجيه الأمر الممنوحة للقاضي الإداري للأمور المستعجلة.
