إذا صدر القرار الإداري صحيحاً، بإستيفائه لأركانه الشكلية، من شكل وإختصاص وأركانه الموضوعية، من سبب ومحل وغايه، كان نافذاً في مواجهة الإدارة من تاريخ صدوره، وفي مواجهة الأفراد من تاريخ إعلانهم به، أو علمهم بصدوره علماً يقينياً، أو من تاريخ نشره بالنسبة للقرارات التنظيمية.
وتجدر الإشارة في هذا الشأن، إلى أن يوسع الإدارة تنفيذ قرارها جبراً على المخاطبين به، حال إمتناعهم عن تنفيذه طوعاً، وذلك من خلال إستعمالها لرخصة التنفيذ المباشر، حال توافر مقتضياتها، إضافة لما لها من حق في اللجوء إلى القضاء لإستصدار حكم.
وينتهي القرار الإداري إدارياً بتنفيذه، أو سحب الإدارة أو إلغائها له، كما قد ينتهي ذلك القرار قضائياً، من خلال لجوء من مس القرار مصلحة مشروعة له للقضاء بدعوى إلغائه، متى توافرت شروط وأسباب قبول تلك الدعوى.
وإنني إذ أتقدم بهذا العمل لجموع العاملين في الحقل القانوني وباحثيه، أدعو الله سبحانه وتعالى، أن يفاد به على قدر ما بذله في إعداده.
