نسد في هذا الكتاب الفراغ الذي أحدثته قوانين التعديل المؤقتة الصادرة خلال سنة 2002 وبعدها في المكتبة القانونية الأردنية، بسبب ما أجرته هذه القوانين من تعديلات عديدة ومهمة في قانون الشركات لسنة 1997، وفي مقدمتها استحدث الشركة المساهمة الخاصة، ولعدم صدور أي شرح لهذا القانون بعد التعديلات المذكورة عليه لحد الآن ورغم احتمال عدم إقرار مجلس الأمة هذه التعديلات كلاً أو جزءً، فإن ذلك لم يفت في عضدنا ولم يثننا عن عزمنا على إصدار هذا الشرح، وخصوصاً وأن من المحتمل جداً أن تمر مدة غير قصيرة قبل انتهاء مجلس الأمة من مناقشة التعديلات المذكورة فيستمر الفراغ الفقهي الحاصل بسببها لمدة غير محدودة وربما طويلة، ولا أدل على ذلك من صدور قانون الشركات المؤقت سنة 1989 وعدم صدور قانون الشركات إلا في سنة 1997، أي بعد ثماني سنوات. وإتباعاً لما جرينا عليه في الجزئين الأول والثاني السابقين في شرح القانون التجاري الأردني، كما في شرحنا القانون التجاري العراقي وفي مؤلفاتنا الأخرى عموماً، فقد حرصنا في هذا الجزء الثالث المخصص للشركات على مقارنة أحكام القانون الأردني مع القوانين الوثيقة الصلة به، وخصوصاً القوانين العربية، وفي مقدمتها القانون اللبناني والسوري والمصري، ولكن كذلك القانون العراقي وقوانين كل من دول الخليج العربي ودول المغرب العربي، إضافة إلى بعض القوانين الأجنبية، وخصوصاً القانون الفرنسي، لتعميم الفائدة ولتمكين الطالب والباحث من رؤية صورة أوسع عن تنظيم الشركات في البلدان العربية والعالم، وتمكينه بالتالي من تكوين آرائه الشخصية عنها، ومن خلال اتخاذ مواقفه الخاصة تجاه القضايا التي طفحت على السطح حديثاً وأثارت العديد من التساؤلات والاختلاف في الرأي.
