لا يملك المحقق المدقق أن ينكر ان القرن العشرين قد كان قترة استثنائية في الشرق الاوسط وذلك نظراً للتحولات السياسية الكبيرة التي عاصرتها المنطقة خلاله ابتداءً بانهيار الامبرطورية العثمانية بعد الحرب العالمية الاولى والتي كانت تسيطر على معظم الدول العربية الى اتفاقية سايكس بيكو في عام 1916، مروراً بالاعلان عن انسحاب القوات البريطانية من الدول التي كانت تحت سيطرتها الى انهاء الانتداب البريطاني على فلسطين والذي بدأ يوم 29 سبتمبر 1923، حيث كان لكل ما تقدم دورٌ محوريّ في إعادة بلورة خارطة الاحداث في المنطقة.
ومع ذلك، فقد كان الحدث الأبرز في هذا الصدد هو الإعلان عن إقامة دولة إسرائيل في فلسطين المنتدَبة، والذي صدر بتاريخ 14 مايو من عام 1948، وحريٌّ بالذكر أنَّ هذا الإعلان كان قد سُبق بخطة تقسيم فلسطين والتي أعلنتها الأمم المتحدة من خلال قرار جمعيتها العامة الصادر بتاريخ 29 نوفمبر 1947 والذي يحمل الرقم 181، وقد أدى هذا الحدث إلى إحداث تغيير هائل في ملامح الوضع السياسي في المنطقة.
يهدف هذا البحث لتحليل العلاقات العربية الإسرائيلية في ضوء قرارات الأمم المتحدة وإتفاقية السلام العربية، وذلك من خلال ربط الدراسة والبحث بالوقائع والأحداث التي رافقت هذه القرارات، حيث نعرض في الفصل الأول لقراريّ مجلس الأمن 242 و338، ولآثارهما القانونية وطبيعتهما الإلزامية، ونولي التركيز في هذا الفصل للقرار 242 نظراً لأهميته والغموض الذي إعتراه، ثم نقوم في الفصل الثاني بتحليل قراريّ الجمعية العامة للأمم المتحدة رقم 181 و 194 لتحديد آثارهما القانونية ودراسة مدى إلزاميتهما للأطراف المعنية.
أما الفصل الثالث فسوف نخصصه للبحث في مبادرة السلام العربية، والآثار القانونية التي قد تُفرض على الأطراف المعنية في حال التوقيع عليها، ونعرض أخيراً للنتائج والتوصيات التي تم التوصل إليها وإستنتاجها في إطار بحثنا هذا.
