اقتضت طبيعه القوات المسلحة بإن يكون لها نظام خاص يشمل جوانب الحياة العسكرية وقد فطن لذلك كثير من المجتمعات القديمة وكان أول من عرف القانون العسكريى الرومان فعرفوا قانوناًُ عسكرياُ إلى جانب قانون العقوبات العام وكانت الجرائم الرئيسية فى ذلك القانون العسكرى من النوع الذى عرف فيما بعد بالجرائم العسكرية البحثة كالهروب من الخدمة أو الهروب من الجيش عموماً وكانت العقوبات فى القانون الرومانى العسكرى لها الطابع التأديبى أو المعنوى كالتنزيل فى الرتبة أو النقل إلى مكان نأئى تعتبر الخدمه فيه مرهقة أو تغيير السلاح إلى مرتبة أدنى فى الشرف العسكرى من المرتبة التى كان يعمل فيها المتهم . وبناء على ذلك يتناول هذا الكتاب دراسة لقانون الأحكام العسكرية انتهجت الدراسة فيه بالتأصيل العلمى فى سبيل البحث عن نظرية عامة ، وقد قامت الدراسة على هدى من النظرية العامة فى قانون العقوبات – وشمل ذلك : الإجراءات والجرائم والعقوبات . وكان الشرح فيه للقواعد الأساسية والفرعية ، ولم يغب النص القانونى عن الدراسة ، إلا أن ذلك تم بطريقة غير مباشرة وبغير الشرح التقليدى على المتون . ويحسب للؤلف ان العمل القضائى قد أكسب الدراسة فيه بحكم تخصصه المهنى تجارب المنصة ، حيث يكون القانون علماً وعملاُ ، وحيث يكون ما جاء فى النصوص مجسداً أمام القاضى . فإذا لم يفصح عنه النص المكتوب فى الظاهر يتبدى صارحاً مشاكله وما أصعب ما يكشفه الباطن !! ، وعلى ضوء ذلك يحسب للكتاب بإنه قد أطل برؤية أوسع على سلطات القادة العسكريين . وتوقف بعمق عند الإحالة والتصديق ، وبحث أموراً جديدة فى التماس إعادة النظر ، وحاول أن يوجد الكثير من الحلول فى مجال العقوبات ، وكشف بشكل غير مسبوق الركن الشرعى فى الجرائم العسكرية .
