أن القوات المسلحة والشرطة لها نظام خاص يتفق وطبيعة الماهم الموكلة إليهما وكذا أشخاص العاملين بهما مما يقتضي أن تكون لهما أحكام خاصة وهذا يعني أن المشرع قد أراد تخصيصا للقضاء الذي يتخصص بالمكان والزمان والأشخاص والموضوع.
لذلك فإن إصدار قانون عكسري متخصص كان هو السبيل الذي أخذت به معظم الدول في قوانينها الحديثة في سبيل التوفيق بين مقتضيات أمن الدولة الخارجي والأمن العام الداخلي وبين حماية الحريات الفردية.
وكان من الطبيعي أن تكون قواعد هذا القانون العسكري تساير قواعد ونظم العمل داخل القوات المسلحة والشرطة التي تتصف بالإنضباط وسرعة التنفيذ والدقة في تحقيق الأهداف.
ولما كانت الحياة العسكرية دستورها الضبط والربط والإنضباط والنظام العسكري وقوامها سرعة إطاعة الأوامر ودقة تنفيذها فكان من الطبيعي أن يحقق القانون العسكري هذه الأهداف.
والجدير بالذكر: أن معظم الدول أصدرت قوانين خاصة بالعكسريين والجرائم والعقوبات العسكرية إلى جانب القوانين الجنائية والعقابية العامة وكان من الطبيعي أن يقوم على تنفيذ القوانين العسكرية قضاء متخصص أيضا هو "القضاء العسكري".
وقد نص الدستور المصري في المادة (183) على أن: "ينظم القانون القضاء العسكري ويبين إختصاصاته في حدود المبادئ الواردة في الدستور ونظراً للإعتبارات السابقة فقد صدر قانون الأحكام العسكرية رقم 25 لسنة 1996 وعمل به إعتبارات من أول يونيه سنة 1996. ونظراً لأهمية هذا القانون وقلة الباحثين فيه فقد رأينا أن يكون هو موضوع هذا الكتاب عسى أن يجد الباحثين فيه والقائمين على تنفيذه سراجاً ينير لهم الطريق المستقيم.
