هذا كتاب لا ينحصر في نطاق القانون الكائن وإنما يحلق في آفاق القانون الواجب أن يكون. ذلك لأن التزام الوضع القائم يبقى الحال على ذات المنوال ويقف عائقاً لانطلاقة التقدم نحو الكمال.
ولذا حرصنا على أن نضمن الكتاب- فوق دراسات القانون المقارن- ما بذله رجال القانون الجنائي في مصر من محاولات إصلاح لتشريعه، تعتبر مرجعاً لكل من تمس به حاجة إلى تلمس الحل الأمثل في أية جزئية من جزئيات القانون، فإما أن يجد في حلها الساري ما يشبع حاسة العدالة وإما يتطلع في صددها إلى حل أفضل لأنه إلى العدالة أقرب.
وليست رسالتنا سوى إرساء أسس القانون الجنائي المثالي، كى تراعى هذه الأسس سواء من جانب القاضي كمطبق للقانون أم من جانب المشرع كواضع القانون.
ولقد كان ولا يزال دأبنا، أن نردف القاعدة النظرية على الدوام بمثال تطبيقي لها أو أكثر، لأن المثال العملي هو محك الصواب في القاعدة النظرية والدليل على انضباطها وتلاؤمها مع نور العقل وحاسة العدالة. وبغير الأمثلة يذهب أئمة التفكير في الحقيقة الواحدة مذاهب شتى مع أن الحق واحد وليس اثنين.
