تبرز أهمية الدراسة في أن اتفاق التحكيم يعد الركن الأساسي في نظام التحكيم، حيث يرتكز على رضاء الأطراف، ومن ثم لا يمكن إلزام شخص بالتحكيم رغماً عن إرادته، ومن هنا يعرف مبدأ نسبية اتفاق التحكيم، ومن ثم لا يحتج به ولا تترتب آثاره إلا بالنسبة للأشخاص الذين ارتضوه وقبلوا خصومته، ولكن ظهر اتجاه يرى إمكانية امتداد شرط التحكيم المتفق عليه من طرفيه إلى غيرهما.
ومن هنا تظهر أهمية هذه الدراسة التي تساهم في الوقوف على أبعاد هذه المشكلة، والوصول إلى الأساس القانوني لهذا الامتداد، مع المقارنة والترجيح بين الآراء، وجمع شتات هذه المشكلة في بحث مستقل، بالإضافة إلى معالجة هذا الموضوع بالمقارنة بين أحكام القانون المدني وأحكام الفقه الإسلامي
