القضاء هو فن إنهاء الخصومات والدعاوى
و الوظيفة الأساسية للقضاء هو تحقيق العدالة ومعاقبة من تثبت إدانته وإعادة الحقوق لأصحابها وتعويضهم.
و من وظائف القضاء الرئيسيّة تفسير القوانين وشرحها وتوضيحها ثمّ تطبيقها؛ فكل قانون يحتاج إلى تفسير من قِبَل القضاة ليُطبق على الحالات المحدّدة المعني بها.
تُحدّد معنى وطبيعة ونطاق هذه القوانين.
و يتميز قضاء الموضوع عن القضاء الاستعجالي بأنه:
" مسطرة مختصرة تمكن الأطراف في حالة الاستعجال من الحصول على قرار قضائي في الحين، معجل التنفيذ في نوع من القضايا، لا يسمح بتأخير البت فيها من دون أن تسبب ضررا محققا".
منشور لوزارة العدل صادر سنة 1959.
الاختصاص الاستعجالي هو الناتج عن عدم جواز المساس بالموضوع الذي يبقى البت فيه من اختصاص قضاء الموضوع لوحده .
