أصبح اهتمام الدول المشاطئة للأنهار الدولية المشتركة لا يقتصر على الملاحة، إنما امتد إلى الاهتمام بتوليد الطاقة، وإقامة المشاريع والسدود لزيادة المساحة المزروعة، ولحماية الفائض من المياه من الصرف في البحر وحجزها وراء السدود، وتحويل مجرى الأنهار، وكذلك منع التلوث، والحرص على البيئة.
لذلك بدأ الفقهاء والمتخصصون والمنظمات الدولية الحكومية وغير الحكومية في دراسة استخدام واستغلال الأنهار الدولية، ووضع القواعد والأنظمة الخاصة بذلك لتنظيم أسلوب اقتسام المياه الدولية حفاظًا على الحقوق المكتسبة والمشروعة، وفي هذا المجال ظهرت الخلافات بين الدول بسبب مصالحها الخاصة في هذه المياه دون النظر إلى الأضرار الناجمة عن ذلك والتي تلحق بالدول الأخرى المشاطئة لذات النهر، لذلك أصبح موضوع المياه من أهم وأبرز المسائل التي يعني بها المتخصصون وتعقد لها المؤتمرات والندوات على المستوى الإقليمي والدولي، حيث ثار التساؤل حول ماهية القواعد القانونية الدولية التي تحكم تلك الاستخدامات؟
ومن هنا فإن تلك السلسلة من الدراسات تحاول إلقاء الضوء حول النظم القانونية التي تحكم استخدامات المياه على المستوى الدولي والمستوى الإقليمي.
وقد آثرت أن أبدأ هذه السلسلة بالدراسة التحليلية لاتفاقية الأمم المتحدة لاستخدام المجاري المائية الدولية في غير الأغراض الملاحية نظرًا لعدة أسباب، منها أن هذه الاتفاقية ذات طابع إطاري حيث تتضمن بنودها تدوين وتفنين للمبادئ العامة والأسس القانونية المتفق عليها في هذا المجال، كما أن موضوعها كان محل دراسة متأنية من قبل لجنة القانون الدولي لفترة ليست بالوجيزة.
وبالإضافة إلى ذلك فإن نصوص الاتفاقية تعكس إلى حد ما التقدم المعاصر في القانون الدولي للبيئة وهذا ما يسترعي الاهتمام.
