يذهب غالبية الفقه إلى أن للدولة ثلاثة أركان، هي ركن الإقليم والسلطة والشعب، وربما أغفل هذا الجانب من الفقه ما للدبلوماسية من دور في حياة الدولة.
بل إننا نشاطر الرأي مع من يذهب إلى أن الدولة لا يمكن أن تنهض دون الدبلوماسية، وإذا نهضت تبقى معتلة لا تستطيع أداء المهام المناطة بها في عصر تسوده النزاعات وتسابق المصالح بل والسعي للتسيد على العالم من أجل إعادته إلى ما كان عليه في عصر شريعة الغاب.
لقد ظلت النظرة للدبلوماسية حتى عهود متأخرة على أنها نوع من الجاسوسية تمارس لمصلحة الدولة التي تمثلها على الدولة التي تعمل فيها، والواقع أن هذه النظرة التي ظلت محل انتقاد غالبية الفقه الدولي، هي نظرة أثبت الواقع صحتها، فلم تعد البعثة الدبلوماسية قادرة على العمل وسط عالم تسوده الصراعات والوسائل غير المشروعة لتحقيق أغراض تعجز الوسائل المشروعة عن تحقيقها.
