تعد عقود تشييد وتشغيل وتوزيع المنتجات النفطية من العقود المهمة التي تبرم في وقتنا الحاضر في العراق، وتأتي أهمية هذه العقود من أهمية المنتجات التي تقدمها كونها مرتبطة بحياة المواطن سواء للإستهلاك المباشر أو للأغراض الصناعية والتجارية لديمومة الحياة اليومية، والتي يكون لها تأثير على واقع التنمية الإقتصادية للدولة بسبب إرتباط إقتصادها ومشاريعها والخدمات التي تقدمها بالمنتجات النفطية، وبطبيعة الحال فأن إرتباطها بالأفراد والشركات عن طريق الخدمات التي تقدمها، أدى الى بروز قضايا ومشاكل قانونية تحتاج إلى تغطيتها ومعالجتها قانوناً.
