إن إجراء مقاربة بين ما يشهده العالم من استخدام مفرط للأسلحة واستحداث أو تطوير غيرها، يفتح المجال واسعا أمام الجهد القانوني، وبالذات في البحث والتحليل القانوني المقارن، للإجابة على السؤال المركزي وهو فيما إذا كانت هذه الأسلحة موافقة للمبادئ القانونية الراسخة بين الأمم المتحضرة.
ولأن النفس الإنسانية ميالة بطبعها إلى الاستحواذ و إلى حد كبير على مجريات النزاعات المسلحة للظفر بالنصر بأي ثمن، من خلال اقتناء أبشع طرق و وسائل القتال، يكون لزاما في المقابل، كبح تلك الميول من خلال التأكيد على مسألة شرعية ومشروعية الاستخدام بل وقبل ذلك وفقا للمادة (36) من البروتوكول الإضافي الأول، لتتجنب الإنسانية بذلك ويلات الحروب وما يصاحبها من الآلام لا مبرر لها في ضوء الميزة العسكرية الأكيدة والمباشرة من العمليات القتالية.
