جدر الإشارة إلى وجود تعريفات متعددة سواء على مستوى الفقه أو مستوى التشريع، وهكذا يمكن تعريف عقد الخصم انطلاقا من التعريفات الكثيرة المقدمة فقهيا بكونه عقد بين الزبون الحامل لورقة تجارية لم يحل بعد أجل استحقاقها والبنك الذي يقبل بتعجيل مبلغ هذه الورقة قبل حلول أجل الاستحقاق مقابل الحصول على فائدة ناتجة عن عملية الخصم تعرف بسعر الخصم، وبمقتضى هذا الاتفاق تنتقل هذه الورقة والحقوق المترتبة عنها إلى البنك الذي يستفيد من قيمتها عند حلول أجل استحقاقها.
