تعددت مفاهيم الهجرة غير الشرعية، وتنوعت مُصطلحاتها العلمية، وشَكَّلَ ذلك الأمر صُعوبة في قياسها ودراستها. فمن حيث التعريف، فإن الأُمم المتحدة تُعَرّفُها بأنها "الدُخول غير المقنن لفردٍ من دولة إلى دولة أُخرى عن طريق البر أو البحر أو الجو، ولا يحمل هذا الدُخول أي شكل من تصاريح الإقامة الدائمة أو المؤقتة، كما تعني عدم احترام المتطلبات الضرورية لعُبور حُدود الدولة" ويُقصد بها - كذلك - الهجرة التي تتعارض مع القوانين التي تحكم الوفود إلى دولة مُعينة أو النزوح منها، من حيث طريقة السفر إلى الدولة وحق البقاء على أراضيها وحق ـــــ
