يعد موضوع دراستنا من المواضيع التي تثير عدة اشكالات قانونية وقضائية،لكونه يرتبط ارتباطا وثيقا بالتنظيم القانوني للعلاقات التي تنشأ بين الافراد داخل كل مجتمع،عدالة او توازن عقدي في العديد من العقود المبرمة سواء منها المدنية أو التجارية أو البنكية،بل إن الظرفية التعاقدية تفرض خضوع الضعيف للأقوى في ظل التطورات الاجتماعية والاقتصادية امام ما يشمل الحياة التعاقدية من تعقيد،واتساع مظاهر الاستهلاك في المجتمع المدني وما نتج عن ذلك من تشعب في المبادلات والمعاملات التجارية،ناهيك عن كثرة النزاعات الناتجة عن الاخلال بتنفيذ الالتزامات التعاقدية،بالاضافة الى بروز صيغ جديدة من التعاقد استلزمتها تقنيات اقتصادية حديثة ( الاعتماد المستندي ،الائتمان البنكي...)،مما يستلزم ضرورة وجود نصوص تشريعية حديثة موازية لهذا التحول التعاقدي ومكملة لما يعتري الطرق التقليدية من نقص أو قصور،وهو الشىء الذي يستدعي الوقوف على قانون الاستهلاك باعتباره من القوانين الاقتصادية الحديثة والتي ساهمت في تجاوز القصور الذي اعترى النظرية التقليدية للعقد.
