لم يكن العرب في يوم من الأيام معزولين عن حركة الأفكار والثقافات والديانات التي عرفها الشرق قديماً كما قد يظنّ البعض، وإنما ظهر الإسلام في مجتمع عرف إختلاطاً وتثاقفاً واسعاً بغيره من الأقوام والمجتمعات التي سبقته في إنشاء حضارات راقية، كالحضارات الرافدية [السومرية، والبابلية والكلدانية والآشورية]، وديانات وثنية/ أسطورية كديانة الخصب السومرية فالبابلية، واخرى سماوية/ توحيدية كاليهودية والمسيحية...
هذا الموروث العريق والغنيّ جداً، ساهم إلى جانب الأعراف الجاهلية السائدة آنذاك، في تشكُّل وانبناء التشريع الإسلامي كما يتجسَّد في القرآن والسُنّة، وهذا ما يريد هذا العمل إثباته وتبيانه. فكيف تعامل الدين الجديد مع هذه المكونات الثقافية والإجتماعية من قصص وأساطير ونصوص كتابية وتقاليد متجذّرة عميقاً في النفوس والوجدان؟ هل رفضها جميعاً أم رفض بعضها وأقرّ البعض الآخر، ولماذا؟ وما هي التجلّيات والتمظهرات الدّالة على ذلك؟
هذه، في العموم، الأسئلة المحورية التي يحاول هذا العمل الإجابة عنها من خلال استقراء الظروف الثقافية والإجتماعية والتاريخية التي أحاطت بنشأة الرسالة الإسلامية، وبيان إلى أي حد أخذ التشريع الإسلامي، ولا سيما في قضايا الأُسرة، من زواج وطلاق وإرث وعلاقات جنسية ونظرة إلى المرأة والعبد... إلخ، من تلك المكونات والمعطيات.
إنه عمل مُحكم ومتكامل، زاخر بالتساؤلات والشواهد، غنيّ بالملاحظات الدقيقة، جريء في تنقيباته وكشوفاته، بل وصادم في بعض تساؤلاته واستنتاجاته.
