میراث در اسلام متن عربی آن از كتاب منهاج الطالبین امام نووی رحمه الله می باشد كه شیخ محمد یوسف سلطان العلماء بر آن شرحی به زبان فارسی نوشته اند و آن را میراث در اسلام نام نهاده اند. هرگاه كسي فوت كرد ابتدا بايد از تركه او هزينههاي تجهيز و تدفين، سپس بدهيهايش پرداخت شود، آنگاه وصيتش اجرا گردد و بعد از آن مالي باقي ماند بر ورثهاش تقسيم ميشود به دليل فرموده خداوند متعال:مِن بَعدِ وَصِيَّةٍ يُوصِي بِهَا أو دَينٍ « سهم شما پس از انجام وصيت مرده و پرداخت بدهيهايش ميباشد»
