ظل السند التقليدي على مدى طويل من الزمن يعتلي قمة الهرم بين أدلة الإثبات كافة، بحيث إن التشريعات كانت تعامل السند التقليدي على أساس أنه أقوى أدلة الإثبات التي يمكن أن تقدم للقاضي لإثبات الواقعة مصدر الحق، وعند توافر الدليل الورقي كان القاضي يصدر حكمه دون أن يراوده شك في الحكم الذي ينطق به.
إلا أن هذا المجد لم يدم في ظل ظهور التكنولوجيا الحديثة وفي ظل ثورة المعلومات والاتصالات وظهور الحاسب الإلكتروني الذي دخل جميع أنحاء الحياة اليومية في مختلف دول العالم، هذه الثورة التي أدت إلى قلب الموازين، وأصبح في ظلها من الممكن لأشخاص من مختلف دول العالم إبرام العقود دون أن يلتقوا معا وذلك عبر وسائل الاتصال الحديثة، وتطور الأمر أكثر وأكثر بعد انتشار الإنترنت فأصبح العالم وبحق بمثابة قرية صغيرة تجمع الأشخاص من مختلف أنحاء وجنسيات العالم بالرغم من آلاف الأميال التي تفصل بينهم.
في ظل هذه التطورات والمستجدات على مستوى الاتصالات والإنترنت والتجارة الإلكترونية فإن المستند التقليدي لم يعد له مكاناً بين هذه الأدوات جميعاً فلا يمكن إثبات عقد تجاري يتم عبر الإنترنت من خلال مستند ورقي أو عملية سحب نقود من جهاز الصراف الآلي أو باستخدام الفيزا بواسطة السند العادي، فقد تطورت وسائل الإثبات بتطور التجارة الإلكترونية ووسائل إبرام العقود.
