الرشوة جريمة نص عليها المشرع الأردني في المواد (170 إلى 173) من قانون العقوبات رقم (16) لسنة 1960 م. وهي من مواد الفصل الأول من الباب الثالث من الكتاب الثاني، الذي تضمن الجرائم المخلة بواجبات الوظيفة، وهي من الجرائم الواقعة على الإدارة العامة. والرشوة فعل يرتكبه موظف عام أو شخص ذو صفة عامة، عندما يتجر بوظيفته أو بالأحرى يستغل السلطات المخولة له بمقتضى هذه الوظيفة وذلك عندما يطلب أو يقبل لنفسه أو لغيره هدية أو وعداً أو أية منفعة أخرى لأداء عمل من أعمال وظيفته أو للامتناع عن ذلك العمل، سواء كان هذا العمل متطابق مع واجبات وظيفته أو مخالف لهذه الواجبات. فالوظيفة العامة تسبغ على الموظف سلطة خطيرة وتمنحه نفوذاً في نطاق اختصاصه، وهذه السلطة وهذا النفوذ أمانة بين يديه، عليه أن يستعملها ويُحسن توجيهها في أداء المصالح العامة التي وكل أمرها إليه. عليه أن يؤدي هذا الواجب بكل نزاهة وحيْدة، لا يتوخى غير الحق والقيام بالواجب، دون ما طمع في مغنم لنفسه أو لغيره أو إشباع لشهوة أو سعي إلى غاية أخرى غير تحقيق المصلحة التي يهدف إليها القانون. هذا هو الواجب على الموظف أو منْ في حكمه أن يفعله، فإذا سولت له نفسه العبث بهذه الأمانة واستغلالها لصالحه الخاص، كان الضرر جسيماً وكانت خيانته لهذه الأمانة جرماً خطيراً، ومن أخطر ضروب هذا العبث أن يجعل الموظف من سلطته ومن نفوذه تجارة يستفيد من ورائها مادياً أو أدبياً، فيقوم بما يطلب إليه أو يمتنع عما يجب عليه، في حق أو في غير حق، لقاء جُعل يتقاضاه أو فائدة يحصل عليها لنفسه أو لغيره أو بعبارة أخرى يجعل الرشوة ثمناً لأداء واجبه أو الامتناع عن أدائه.
