لم تكن قضية حقوق الإنسان مطروحة بشكل واسع في الماضي كما هي اليوم، خاصة في هذا العصر الذي تنتهك فيه هذه الحقوق بشكل سافر وفي أكثر من مكان من العالم.
والحديث عن حقوق الإنسان حديث قديم جديد فهي موجودة منذ أن وجد الإنسان ولا تزال قائمة إلى يومنا هذا، وهي نابعة من ضرورة إحترام الإنسان لأخيه الإنسان لأن في هذا الإحترام مدخلاً إلى التقدم والإستقرار، لقد أولى الإسلام هذه القضية الإهتمام والرعاية والجهد وحسن التطبيق حرصاً على نقاوة المجتمع الإسلامي من الفاسدين والمفسدين وعلى الإنسان بالذات كي يكون عنصر خير وعطاء في المجتمع.
لقد كان موقف الإسلام من قضية حقوق الإنسان نابعاً من مصدرين هامّين للتشريع الإسلامي هما القرآن والسنّة، فالقرآن بإعتباره الكلام المنزل من الله والشامل لكل أُمور الحياة والناظم لعلاقات الأفراد فيما بينهم، قد وضع الأسس العملية لهذه العلاقة بحيث لا يطغى فرد على فرد أو جماعة على أخرى، وحتى يكون المجتمع سليماً ومنظماً كانت هذه القوانين الجنائية الإسلامية المستمدّة من القرآن لتضع الحدود لكل فرد فلا يتعدّاها حتى لا يسيء إلى الآخرين بشكل أو بآخر "لا ضرر ولا ضرار".
وأما السنة فلقد جاءت الشريعة هداية للإنسان المسلم كي لا ينحرف عن الطريق المستقيم فوضعت له القواعد والنظم والأحكام التي أنزلها الله سبحانه وتعالى على عباده بلسان رسوله النبي "محمد صلى الله عليه وسلم".
ولأهمية هذا الموضوع، تناوله "محمد الطاهر الرزقي" في كتابه هذا ليسلط الضوء على أهمية حقوق الإنسان ومفهومها في الشرع الإسلامي وفي القوانين الجنائية.
