المسائل الاقتصادية وما يتصل بها، كانت ولا تزال الشاغل الأول للتفكير البشري وبخاصة في هذا العصر الذي طغت عليه المادة بمفاسدها ومفاتنها، ويحاول المفكرون من العلماء إيجاد الحل الأمثل للقضاء على الفقر وسوء التوزيع.
ولقد ساعد على زيادة تعقيد المسألة الاقتصادية، أن كثيراً من الباحثين فيها نظروا إليها نظرة مجردة دون ملاحظة ارتباطها بمسائل الحياة البشرية الأخرى، حتى جعلها بعضهم مشكلة البشرية، وأنها وحجها المؤثرة في كل مظاهر الحياة الإنسانية.
وقد هيمن هذا الاتجاه على معظم الباحثين في المشكلات الإنسانية، فمنهم من ينظر لمشكلات الحياة الإنسانية بمنظار الجنس، وآخرون بمنظار العلم الطبيعي أو بمنظار الأبحاث النفسية أو بمنظار الارتقاء الروحي والخلقي.
والشريعة الإسلامية باعتبارها خاتمة الشرائع الإلهية، جاءت وافية بحاجات الناس في شتى ما يحتاجون، ومحققة لسعادتهم الدنيوية والأخروية على أكمل الوجوه في كل زمان ومكان، فهي منهاج كامل للحياة البشرية، بكل مقوماتها في عالم الروح والمادة وفي ضمير الفرد أو محيط الجماعة، ولا يمكن أن تضاهيها أو تقاربها فكرة أو رسالة أخرى، لأنها منهج علمي يقوم على رسم الخطوط الأساسية للقواعد التفصيلية التي تركت لمقتضيات التطور من حيث الزمان والمكان.
والدراسة التي بين يدينا تتناول الملكية ونظرية العقد في الشريعة الإسلامية بما يكشف للناس أن هذه الشريعة قد نظمت المسائل الاقتصادية كغيرها من سائر المسائل الإنسانية، بما يحقق للإنسان سعادته، ويضمن له الظفر بمطالب الحياة.
هذا وقبل عرض أحكام الملكية والعقد تم إيجاز الكلام عن حقيقة المال وأقسامه باعتباره محل الملك.
