يضم هذا الكتاب دراسة فقهية علمية قيمة، تبحث في موضوع الملكية في الشريعة الإسلامية، حيث تتحدث في الباب التمهيدي عن نشأة نظام الملكية وتطوره التاريخي، فعرض لنماذج مختلفة لحال الملكية في المجتمعات البشرية المتعددة في العصور المختلفة، فتناول نظم الملكية في الديانة اليهودية والنصرانية والبوذية والزرادشتية، كما وتذكر بعض ما ساء من نظم الملكية في الحضارات القديمة، من الملكية عند البابليين، والفرس والملكية في مصر القديمة، والملكية في المجتمع العربي قبل الإسلام، والملكية عند اليونان والرومان، من ثم تتوقف عند نظام الملكية الذي ساد في العصور الوسطى، فتذكر ما يتعلق بالإقطاع وموقف الكنيسة.
وهكذا جاء الباب الأول من الدراسة مخصصاً لبيان طبيعة الملكية في الشريعة الإسلامية والقوانين والنظم الوضعية، وخصص الباب الثاني للكلام عن قيود الملكية في الشريعة الإسلامية. وأما الباب الثالث فأفرده للكلام عن وظيفة الملكية في الشريعة الإسلامية على سبيل المقارنة، وعرضت الخاتمة لأهم النتائج التي تم التوصل إليها من خلال هذه الدراسة.
