إن لكل فقه مصادره، ولكل تشريع مستنده، ولما كانت أحكام الفقه الإسلامي منقسمة إلى قطعيات وظنيات، وكانت مصادره كذلك. منها ما هو قطعي بذاته كالكتاب والسنة، ومنها ما هو ظني متفق عليه عند أكثر الفقهاء، كالإجماع والقياس، ومنها ما هو ظني مختلف فيه اختلافاً واسعاً كمذهب الصحابى الذي يتم دراسته في هذا الكتيب. وإن استقصاء المباحث التي تتعلق بمذهب الصحابى تتسع لأن تكون موضوع أطروحة جامعية موسوعة، إلا أن المؤلف قصر بحثه على حجية مذهب الصحابي من بعض الجوانب وباختصار يعطينا لمحة عن آراء الفقهاء في مصدرية مذهب الصحابي للتشريع، ومدى حجيته في الاستدلال على الأحكام، وآراء المذاهب في ذلك، وأدله كل فريق ومناقشته. وقد تضمن البحث مدخلاً وثلاثة فصول وخاتمة، وملحق.
حرر الباحث في المدخل مصطلح البحث وبين محله ومحترزاته. وعرض في الفصل الأول آراء الفقهاء في المسألة مع نسبتها إلى أصحابها وتوثيقها وتحقيق آراء المذاهب المشهورة في الاحتجاج بمذهب الصحابي. واستقصى في الفصل الثاني أدلة كل رأي من الآراء المذكورة. وذكر في الفصل الثالث ما نوقش به كل دليل من الأدلة المذكورة، كما ذكر ما يمكن أن يناقش به الدليل عندما لا يناقشه الأصوليون. ثم ختم البحث ببيان القول الراجح. وأردفه بملحق يتضمن أمثلة تطبيقية على أثر الاختلاف في المسألة.
