أصبحت جريمة إستغلال النفوذ، جريمة منتشرة، توجد في غالبية الدول والمجتمعات، لكن بنسب متفاوتة من دولة إلى أخرى، حسب وسائل مواجهتها الوقائية، والعقابية، وكيفية إدارة مؤسساتها العامَة، لذلك فهي تهدَد الأمن الإقتصادي، والإجتماعي، والسياسي، كلَ هذه الأسباب، جعلت ظاهرة إستغلال النفوذ، ذات خطورة كبيرة، سواء على المستوى الدَولي، أو على المستوى الوطني، لذا برزت الحاجة إلى معالجتها تشريعات واتخاذ خطوات واسعة، للإصلاح القانوني، والإداري لمعالجة ظاهرة إستغلال النفوذ، رغم اختلاف تلك الدول في تجريمها ومكافحتها، هناك دول أخرى، لم تتطرق تشريعاتها إلى هذه الجريمة، مما يعتبر فراغاً في التشريع الجنائي، حيث يؤدي ذلك إلى سوء الإستفادة من قبل أصحاب النفوذ، ليتدخلوا في شؤون السلطة العامَة كيفما يشاؤون. وتكمن أهميَة هذا الكتاب، في دراسة ظاهرة إستغلال النفوذ، ومالها من تأثير سلبي، ونتائج هدَامة على المجتمعات والدول على حد سواء، مما يؤدي إلى الإخلال بمبدأ المساواة أمام المرافق العامَة وأمتيازاتها، وعدم الثقة بالدولة وموظفيها فالحق المعتدى عليه في جريمة استغلال النفوذ الوظيفي هو نزاهة الوظيفة العامة وهو حق أساسي لكل أفراد المجتمع فالإتجار بأعمال الوظيفة العامَة يهبط بها إلى مستوى السلع، والموظف العام والمكلَف بخدمة عامة هو الوسيلة لأداء هذه الخدمة، والأثراء غير المشروع من وراء ذلك يعد إثراءاً بلا سبب يسلب الدولة والوظيفة العامَة الإحترام الذي يجب أن تحظى به.
يساهم هذا الكتاب في تدعيم الحلول التي وضعتها الأنظمة القانونية للحد من هذه الظاهرة ومكافحتها وذلك بالوقوف على السبل الناجعة في وقتنا الحاضر للوقاية والعلاج منها، والتطور القانوني والإداري الذي شهده العالم في هذا الصدَد.
