ينطلق المؤلف في معالجته موضوع تفتيش المنازل والأشخاص من مبدأ توزيع أحكامه ضمن قسمين أساسيين، بحيث خصص القسم الأول من الدراسة لتحديد مضمونه والسلطات المختصة بإجرائه، بينما تطرّق الى وسائله وجزاء مخالفة الإجراءات المفروضة قانوناً في القسم الثاني منها.
وقد رأى المؤلف بعد عرض مستفيض للنصوص القانونية أن الضمانات التي تحيط بعمليات التفتيش ليست كافية حتى في الأطر التي حددها قانون أصول المحاكمات الجزائية الجديد، بحيث بات يشكل إجراءً من إجراءات التحقيق الأولى خارج الجرم المشهود والذي يمكن للنيابة العامة القيام به، أو الإذن للضابطة العدلية بإجرائه مع ما يشكل ذلك من نتائج قد تصيب حقوق الإنسان وحرياته الأساسية في الصميم وتعرّضها لإنتهاكات تجعلها غير مقبولة ضمن هذا الواقع.
وبذلك يتعيّن برأي المؤلف من أجل معالجة هذا الخلل، العمل على تحديد الحصانات بصورة واضحة بحيث يكون القانون عام التطبيق على الأفراد دون تمييز، مع الإبقاء على بعض الحصانات التي تفرضها القوانين طبقاً لمبدأ المعاملة بالمثل ويقع في نطاقها الحصانات الدبلوماسية في الدرجة الأولى.
