الجريمة المشهودة هي الجريمة التي تشاهد عند وقوعها، أو التي يقبض على فاعلها أثناء ارتكابها، وقد استأثرت الجريمة المشهودة وخاصة الجنائية منها بإجراءات خاصة واستثنائية نص عليها القانون. وقد وردت الإشارة إلى حالات الجرائم المشهودة في قانون أصول المحاكمات الجزائية اللبنانية الصادر في 18/9/1948 حيث حدد المشرع حالات الجرم المشهود بصورة واضحة وحصرية.
وفي هذا الكتاب يقدم المؤلف دراسة مقارنة لموضوع الجريمة المشهودة وهي دراسة متخصصة موثقة بالمراجع العربية والفرنسية ومعززة بالأحكام القضائية الصادرة عن المحاكم في لبنان وفرنسا ومصر. والكتاب يقع في قسمين: القسم الأول يبحث في ماهية الجرائم المشهودة وحالاتها وتطورها. ويعرض للإضافات التي طرأت على النص القانوني حتى ما وصلت الجريمة المشهودة إلى ما هي عليه اليوم في قانون أصول المحاكمات الجزائية الجديدة.
ويعرض القسم الثاني في تنازع الصلاحيات وأثر الحصانات على الجرائم المشهودة والمؤلف يدرس في هذا القسم بعض الاستثناءات التي ترد على الإجراءات المنصوص عليها قانوناً لبعض الأشخاص من عدم ملاحقتها جزائياً على الإطلاق أو جعل ملاحقتها ضمن إجراءات خاصة معنية.
