يخضع كل علم في تحقيقه وإثباته إلى منهجية معينة، وتتجلى المنهجية بمجموعة من التوجيهات والضوابط تحكم عمل الباحث في سعيه نحو الوصول إلى حقيقة معينة، فهناك أدوات البحث لا بد من الإحاطة بها ثم هناك طريق لا بد من سلوكه عند إستعمال تلك الأدوات، فغاية المنهجية هي أن يحسن المرء توجيه فكره عند بحثه عن الحقيقة في علم من العلوم، كعلم القانون مثلاً، فإن رجل القانون الممتهن أو الطالب أثناء الدراسة يحاول كل منها أن يتلمس المنهجية التي يمكنه إتباعها لإنجاز عمله، علّ المنهجية تهديه إلى الطريق القويم.
إلا أن المنهجية في القانون لم تكن تدرس في كلية الحقوق كمادة مستقلة، بل كان الطالب يستكشف بعض ضروبها عَرَضاً بمناسبة حل المسائل أو التعليق على القرارات القضائية أو وضع الأبحاث القانونية في بعض المواد، وإذا ما انتهى من الدراسة وانتقل إلى ممارسة حياته المهنية في حقل القانون فيتلمس بعض ضروب المنهج لعمله من خلال الممارسة والخبرة.
وإذا حاول الباحث أن يفتش عن مرجع يهديه إلى المنهجية التي يجب عليه إتباعها فلا يجد أي مرجع عام بهذا الموضوع.
من هنا، جاء هذا الكتاب الذي يبحث في المنهجية التي يصح إعتمادها في كل عمل من تلك الأعمال مع إعطاء أمثلة تطبيقية عن كل منها، وتبعاً لذلك يقسم الكتاب إلى قسمين: القسم الأول: منهجية حل النزاعات القانونية، القسم الثاني: منهجية وضع الدراسات القانونية.
