تختلف النظم الاقتصادية من بلد إلى آخر، تبعاً للإيديولوجية السياسية التي ينطلق منها دستور ذلك البلد. فالدول الديمقراطية تعتمد نظام الاقتصاد الحر، أما الأنظمة الشمولية فهي تعتمد نظام الاقتصاد الموجه الذي يفرض قيوداً على الحريات الاقتصادية ويقوم نظام الاقتصاد الحر على مبدأ حرية التجارة والصناعة وحرية المنافسة.
وهنا يكتسب عنصر الزبائن أهمية كبرى بالنسبة لكل النشاطات المهنية والاقتصادية، إذ يتوقف على ذلك نجاح أو فشل المؤسسات التجارية التي تتزاحم على كسب الزبائن وإرضائهم. لكن المزاحمة إن تركت دون قيود وضوابط تحكمها فإن من شأن ذلك أن يؤدي إلى نشوء الاحتكارات ما يفضي بالتالي إلى زوال المنافسة.
لذا عمد المشرعون إلى وضع ضوابط لهذه المزاحمة لكي تبقى في إطارها السليم والقوانين اللبنانية حرصت كغيرها على تأمين الحماية للملكية التجارية والصناعية والأدبية والفنية بمختلف أشكالها كما وضع كوابح من المزاحمة غير المشروعة حيث اعتبر المشرع أن مخالفة قواعد حماية الملكية الصناعية والتجارية تشكل جرماً جزائياً يعاقب عليه بالعقوبة المنصوص عليها في قانون العقوبات. وبهدف الإحاطة بهذه المشكلة ومعرفة وجوه المزاحمة غير المشروعة وضع هذا الكتاب الذي يعالج في قسمين رئيسين، مفهوم الطفيلية أو المزاحمة غير المشروع، والادعاء بموضوع الطفيلية وهو مؤلف جديد في بابه ويعد مرجعاً لا غنى عنه لكثير من المتخصصين.
