بحث المؤلف في هذا الجزء من الكتاب الخطأ بحد ذاته، فتولى تعريف الخطأ وبيان عناصره في الفصل الأول، ثم عرض لبيان أنواع الخطأ في الفصل الثاني، وشرح في الفصل الثالث بعض تطبيقات الخطأ التشريعية، كالاتلاف والغصب والأعمال غير المشروعة التي تقع على النفس، والتعسف واستعمال الحق، وقد حاول بالنسبة للفقه الوضعي إبراز موقف التشريع العراقي وخصائصه التي يتميز بها عن القوانين الوضعية الأخرى عربية وغير عربية، وقد خصص الفصل الرابع للخطأ الفني أو المهني، أما الفصل الخامس فقد بحث في مسؤولية الأشخاص المعنوية الخاصة منها والعامة، وعالج الفصل السادس حالات انعدام الخطأ، وختم هذا الجزء من الكتاب بالفصل السابع الذي تناول معالجة إثبات الخطأ ورقابة محكمة التمييز. ولقد سار المؤلف في هذه الفصول جميعاً على طريقة الدراسة الفقهية المقارنة، ومع هذا لم يغفل موقف القضاء وإنما أولى الأحكام القضائية العملية عناية خاصة، فعرض في معظم مباحث هذا الجزء لموقف القضاء العراقي.
